Intent to Communicate

Our company is governed by state and federal legislation regarding privacy of information and security surrounding personal data -- without consent of a consumer, with the exception of a community property state, we may not disclose information to an unauthorized third party.

All physical or electronic personal data is kept in a secured format in our company, and is only accessible by authorized parties.  Any payment information retained by our office is in accordance with the Electronic Payments Association (https://www.nacha.org/achrules) and Payment Card Industry Data Security Standard (PCI DSS).

Under the Fair Debt and Collection Practices Act, Schedule F, if a consumer wishes to express their preference for communication they can do so.

     WE ARE REQUIRED BY LAW TO GIVE YOU THE FOLLOWING INFORMATION ABOUT THIS DEBT:  The legal time limit (statute of limitations) for suing you to collect this debt expires after six years from the date the debt became due.  However, if someone sues you outside of this period to try to make you pay this debt, the court rules REQUIRE YOU to tell the court that the statute of limitations has expired to prevent the creditor from obtaining a judgment.  Even though the statute of limitations may have expired, you may choose to make payments.  However, be aware that if you make a payment, the creditor’s right to sue you and the statue of limitations may start again. 

     If a creditor or debt collector receives a money judgment against you in court, state and federal laws may prevent the following types of income from being taken to pay the debt:  supplemental security income (SSI), social security, public assistance (welfare), spousal support, maintenance (alimony), child support, unemployment benefits, disability benefits, workers compensation benefits, public or private pensions, veterans benefits, federal student loans, federal student grants, federal work study grants, and ninety percent of your wages or salary earned in the last sixty (60) days.

     The federal (Fair Debt Collection Practices Act) prohibits collection agencies from engaging in abusive, deceptive, and unfair practices including but not limited to the use or threat of violence, the use obscene or profane language, and repeated phone calls made with the intent to annoy, abuse, or harass.

Federal law prohibits agencies from contacting you about your debt if you send a letter requesting that all contacts stop.
